19. Can EMC experts review testimony in an active malpractice case where erroneous testimony is suspected?

Neither EMC nor any of its review activities can be utilized in any ongoing individual medical malpractice matter. The organization bylaws and mission statement are specific in that testimony review processes of the company can only take place in closed cases, including resolution of any appeals. Without exception, EMC will not receive, accept or review any documents or authorize any review process related to an individual malpractice matter unless legal documentation that the case is closed is provided. The mission of EMC cannot be aborted to interfere with the court and its designation of experts in any pending matter.
